Article 311 Part XIV

Dismissal, removal or reduction in rank of persons employed in civil capacities under the Union or a State

Quick Summary (TL;DR)
Constitutional Protection of Civil Servants: Guarantees that no government employee can be dismissed, removed, or demoted by an authority subordinate to the one that appointed them, or without a fair departmental inquiry and hearing.
Article 311 is the constitutional shield that allows honest government officers, teachers, clerks, railway staff, and police personnel to work without fear of political vendetta. It provides two ironclad safeguards:
1. Article 311(1): No civil servant of the Union or a State shall be dismissed or removed by an authority subordinate to that by which they were appointed.
2. Article 311(2): No civil servant shall be dismissed, removed, or reduced in rank EXCEPT after an inquiry in which they have been informed of the specific charges against them and given a reasonable opportunity of being heard in respect of those charges (Natural Justice).
Right to a written Charge-Sheet, access to evidence, cross-examination of witnesses, and personal hearing before any major penalty (Art 311(2))
Immunity from being fired by a junior officer subordinate to the Appointing Authority (Art 311(1))
Protection extended to both permanent and officiating/probationary civil servants when termination carries a stigma (Parshotam Lal Dhingra ruling)
Right to challenge arbitrary suspension, transfer malice, or wrongful dismissal before CAT/SAT or the High Court under Article 226
Under the proviso to Article 311(2), the mandatory inquiry can be dispensed with ONLY in three exceptional cases: (a) conviction on a criminal charge, (b) where the authority records in writing why it is not reasonably practicable to hold an inquiry (subject to strict judicial review), or (c) where the President or Governor is satisfied that in the interest of the Security of the State it is not expedient to hold such inquiry.
Protects millions of government employees and their families from being fired on the spot simply for refusing an illegal political order.
